Engagement ring ownership disputes are frequent and often hotly contested due to the emotional aspect of a failed relationship and the ring’s sentimental and economic value. Governing law has changed over the years.
The original rule of law followed in a majority of states was fault-based. The legal question asked was: Who caused the breakup? Courts would award the ring to the innocent party. But this fault rule required assessment of blame, and the testimony of the parties was often conflicting and nasty.
